End-User Licence Agreement

This End-User Licence Agreement (“EULA”) is between you and BuonaLabs UG (haftungsbeschränkt) (“Enfigure”, “we”), Maria-Goeppert-Straße 3, 23562 Lübeck, Germany. It covers the Enfigure desktop application, its model packs and its updates (“the Software”). By installing or using the Software you accept this EULA. For customers habitually resident in Germany, mandatory consumer law overrides anything below that would reduce it. The Terms of Service also apply.

1. Licence grant

While your Enfigure account is active, we grant you a limited, non-exclusive, non-transferable, revocable licence to:

• install and use the Software on up to 3 personal devices signed in to your account;
• use the Software to create, edit and export content for any lawful purpose, including commercial projects.

The licence is for the account holder. Do not share your account or sign-in.

2. Restrictions

You may not:

• copy, rent, lease, sell, sublicense or distribute the Software or your account;
• sign in to the Software on more than 3 devices, or let others use your account;
• reverse engineer, decompile, disassemble or extract models, data or source code from the Software, except where the law gives you that right despite this limit;
• remove copyright or licence notices;
• bypass sign-in or device checks;
• use the Software to build a competing product from its models or packs;
• use the Software in breach of the law.

3. Beta software

The Software is a public beta. It may have errors, change or lose features, and may crash or lose work. Save often. Beta builds are provided for evaluation and use, with no promise of support, availability or compatibility with future versions.

4. Updates

Every beta build is included for every signed-in account. We may release updates and may require you to install an update to keep using the Software or the sign-in check. Some updates add, change or remove features.

5. Model packs

Some features use model packs that you download. Model packs are part of the Software. They are licensed to you under this EULA, only for use inside the Software. You may not extract, redistribute or use them outside the Software.

6. Your content and output

• You own the files you import and the characters, garments, textures and other files you export. We claim no rights in them.
• You are responsible for having the rights to what you import, and for how you use your exports.
• Enfigure runs on your computer. We do not receive your projects or exports.
• Parts of the Software that ship with sample content (for example the sample character, starter garments, presets and library items) are licensed to you for use in your own projects, as stated in the Library, unless a file says otherwise.

7. Privacy

The Software checks your sign-in and device list with our servers and downloads updates and packs. See the Privacy Policy.

8. Termination

This EULA ends when your account is closed, or if you break it. When it ends, you must stop using the Software. Content you already exported stays yours. We may sign out your devices at that point.

9. Conformity and warranty

If you are a consumer, the statutory rules for digital products apply, including rights where the Software is not in conformity with the contract.

For a business customer, and for any claim the law allows us to limit, the Software is provided as available. We do not warrant that every export will open in every engine or tool.

10. Limitation of liability

Nothing in this EULA limits liability for intent, gross negligence, injury to life, body or health, or liability the law does not allow to be limited.

For a slight breach of an essential duty, liability is limited to damage that was typical and foreseeable. Any other claim for slight negligence is excluded. Where a cap is allowed, our total liability is limited to the amount you paid us in the 12 months before the claim.

11. Governing law

This EULA is governed by the laws of Germany, subject to any mandatory consumer rights where you live.

12. Changes

We may update this EULA. We will post the new version with a new date. If you keep using the Software after a change takes effect, you accept it. The Terms of Service also apply.
