Terms of Service

These Terms are a contract between you and BuonaLabs UG (haftungsbeschränkt) (“Enfigure”, “we”), Maria-Goeppert-Straße 3, 23562 Lübeck, Germany. They cover the Enfigure website, your account and Enfigure Pro. The desktop app is also covered by the End-User Licence Agreement.

The German text at the end prevails for customers habitually resident in Germany.

By creating an account or placing an order you agree to these Terms. If you do not agree, do not use the service.

1. Accounts

You must be at least 18 years old. Give accurate information and keep your sign-in safe. You are responsible for activity on your account. You can sign in with email and password, or with Google, GitHub or Discord when those options are shown. You can delete your account in Settings.

2. The service

Enfigure is desktop software. It runs on your computer. We do not receive your 3D files. The service is in public beta. Features can change. Keep your own copies of your work.

3. Plans and price

Free costs nothing and needs no card.

Enfigure Pro is a monthly subscription. The net price is €18.00 per month, billed in advance in euros. VAT is added from your billing country:

• A consumer in Germany pays €21.42 per month, including 19% German VAT.
• A consumer in another EU country pays that country’s standard VAT on electronic services. The total is shown before you pay.
• A business in another EU country with a valid VAT ID pays the net price. The VAT is then accounted for by the customer (reverse charge). A German business pays German VAT.
• A customer outside the EU is not charged German VAT. Local tax, where Stripe Tax applies it, is shown before you pay.

The total price, the monthly duration, and the fact that the subscription renews until you cancel are shown on the checkout page and again on the Stripe payment page. The contract is concluded when you confirm payment there. On our checkout page the button is labelled Zahlungspflichtig bestellen.

We use Stripe Payments Europe, Limited to take payment, calculate tax and issue invoices. We do not store your full card number.

When Pro starts

A consumer can order only by expressly requesting that Pro starts immediately and acknowledging that the right of withdrawal ends once performance has begun. That box is not pre-ticked. A business orders by stating that it is a business and giving its company name. We keep the text and the time of that confirmation.

Renewal, cancellation, failed payments

The subscription renews each month at the then-current price until you cancel. You can cancel at any time, with effect at the end of the period already paid. Use Verträge hier kündigen or Billing in your account. The confirmation button is labelled jetzt kündigen. We confirm by email. You keep Pro until the period ends. We do not refund unused days of a period that has started, except where the withdrawal instructions or a defect in the digital product require it.

If a payment fails, we may retry it and we may suspend Pro. A chargeback ends Pro.

We may change the price. We will email you at least 30 days before the new price applies. It applies from the next renewal. If you do not agree, cancel before that renewal.

4. Acceptable use

Do not break the law or infringe other people’s rights. Do not share your account, exceed 3 devices, or bypass sign-in. Do not reverse engineer the software except where the law allows it anyway. Do not attack or overload the service. Do not use it to sexualise minors or to create illegal content. Do not abuse refunds, withdrawal or chargebacks.

5. Intellectual property

You keep all rights in the files you import and in what you export. We do not receive those files. You are responsible for having the rights to what you import.

Enfigure, its models, packs, website, name and logo belong to us and our licensors. Your licence to use the software is the End-User Licence Agreement.

6. Ending the contract

You can stop by cancelling and deleting your account. We can suspend or end an account if you break these Terms, if payment fails, or if the law requires it. We give notice where that is reasonable. Files you have already exported stay yours.

7. Liability

Nothing in these Terms limits liability for intent, gross negligence, injury to life, body or health, or liability that the Product Liability Act or another statute does not allow to be limited.

For a slight breach of a duty that is essential to the contract, our liability is limited to the damage that was typical and foreseeable when the contract was made.

For consumers, the statutory rules on digital products (§§ 327 ff. BGB), including rights where the product is not in conformity, remain in force. We do not promise that a beta build will be uninterrupted or that every export will open in every tool.

Any other claim for slight negligence is excluded. Our total liability for a claim that can be limited is capped at the amount you paid us in the 12 months before the claim.

8. Law and courts

German law applies. If you are a consumer and mandatory law in your country of residence gives you protections, those protections remain. A consumer may sue in the courts of their residence. We may sue a consumer only in the courts of their residence. For a business, the courts of Lübeck have jurisdiction. We do not take part in consumer arbitration (§ 36 VSBG).

9. Changes

We will post a new version here with a new date and, for a material change, tell you by email or in the app. If you do not agree, cancel before the change applies. The change does not reduce rights you already have for a period you have paid for.

Diese Bedingungen sind der Vertrag zwischen Ihnen und der BuonaLabs UG (haftungsbeschränkt), Maria-Goeppert-Straße 3, 23562 Lübeck. Für Kunden mit gewöhnlichem Aufenthalt in Deutschland geht dieser deutsche Text vor.

Enfigure Pro kostet netto 18,00 Euro im Monat, im Voraus, in Euro. Für Verbraucher in Deutschland beträgt der Gesamtpreis 21,42 Euro im Monat einschließlich 19 % Umsatzsteuer. Die im Checkout und auf der Stripe-Zahlungsseite angezeigte Summe ist der von Ihnen zu zahlende Preis. Der Vertrag kommt zustande, wenn Sie die Zahlung dort bestätigen. Die Schaltfläche auf unserer Seite lautet „Zahlungspflichtig bestellen“.

Die Laufzeit beträgt zunächst einen Monat und verlängert sich jeweils um einen weiteren Monat, bis Sie kündigen. Sie können jederzeit zum Ende des bereits bezahlten Zeitraums kündigen, über Verträge hier kündigen. Die Bestätigungsschaltfläche lautet „jetzt kündigen“. Wir bestätigen die Kündigung per E-Mail. Der Zugang bleibt bis zum Ende des bezahlten Zeitraums bestehen.

Verbraucher können nur bestellen, wenn sie ausdrücklich verlangen, dass Pro sofort beginnt, und bestätigen, dass das Widerrufsrecht mit Beginn der Leistung erlischt. Das Kontrollkästchen ist nicht vorausgewählt. Die Widerrufsbelehrung gilt. Unternehmer bestellen als Unternehmer; ein gesetzliches Widerrufsrecht besteht dann nicht. Mängelrechte an digitalen Produkten (§§ 327 ff. BGB) bleiben.

Die Haftung für Vorsatz, grobe Fahrlässigkeit, Verletzung von Leben, Körper oder Gesundheit und nach dem Produkthaftungsgesetz ist nicht beschränkt. Bei leichter Fahrlässigkeit haften wir nur bei Verletzung wesentlicher Vertragspflichten und nur für den typischen, vorhersehbaren Schaden. Weitergehende Ansprüche aus leichter Fahrlässigkeit sind ausgeschlossen. Soweit eine Haftungshöchstgrenze zulässig ist, ist sie auf das in den zwölf Monaten vor dem Anspruch gezahlte Entgelt begrenzt.

Es gilt deutsches Recht. Zwingende Verbraucherschutzvorschriften des Staates Ihres gewöhnlichen Aufenthalts bleiben unberührt. Für Unternehmer ist Lübeck Gerichtsstand. Wir nehmen nicht an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teil (§ 36 VSBG).
